EEC Guidelines on Settlement Procedures and Pecuniary Penalty Determination
The Commission hereby notifies the public that it has developed guidelines on the approach to be used when determining what constitutes an appropriate pecuniary penalty during settlement negotiations. The aim of publishing these guidelines is to ensure that the processes of the Commission are transparent and supported. Furthermore, it aims to enchancing procedural fairness and impartiality during settlement negotiations. These guidelines are effective as of February 2023 and will apply to all pending cases where settlement agreements have not yet been initiated and future cases involving settlement.
