Memoranda of Understanding

In terms of Section 67, the Commission is under obligation to cooperate with sectoral regulators which has competition powers. The Commission has thus far concluded Memorandum of Understanding (MOUs) with the Communications Regulatory Authority of Namibia (CRAN), Namibia Ports Authority (Namport) and the Bank of Namibia (BoN). It should be noted that the MOUs are not aimed at sharing competition responsibilities. It is rather aimed at formalizing cooperation to improve efficiency and avoid duplication of processes.

Memorandum of Understanding with BoN

The Namibian Competition Commission (NaCC), in terms of Section 67(3) of the Competition Act, 2003 (Act No. 2 of 2003), herewith gives notice that it has entered into an agreement with the Bank of Namibia, dated 01 February 2012.

In terms of section 2 of the Bank of Namibia Act, 1997 (Act No. 15 of 2007, as amended) the Bank of Namibia is, interalia, required to promote and maintain a sound monetary, credit and financial system and sustain the liquidity, solvency and functioning of that system, as well as to control, supervise and regulate all banking institutions in accordance with the provisions of the Banking Institution Act, 1998 (Act No. 2 of 1998, as amended) and to provide for the management, administration, operation, regulation and oversight and supervision of payment, clearing and settlement systems in Namibia and to regulate user fees and charges for payment services in accordance with the provisions of the Payment System Management Act, 2009 (Act No. 18 of 2003, as amended).

Memorandum of Understanding with CRAN

The Communications Regulatory Authority of Namibia, in terms of Section 67(3) of the Competition Act, 2003 (Act No. 2 of 2003), herewith gives notice that it has entered into an agreement with the Namibian Competition Commission, dated 01 February 2012.

In terms of Sections 33 and 34(1) of the Communications Act, (Act No.8 of 2009), the Communications Regulatory Authority of Namibia, is authorised to promote competition in the market for the supply of telecommunications and broadcasting services and products, and to promote, develop and enforce fair competition and equality of treatment among all providers of telecommunications and broadcasting users of such services.
